On April 24, the U.S. Department of Commerce announced the postponement of the announcement of the final results of China's photovoltaic anti-dumping investigation.
Previously, the U.S. Department of Commerce conducted an administrative review of the anti-dumping duty order on crystalline silicon photovoltaic cells (whether assembled into modules or not) originating in China, and the investigation period was between December 2020 and November 30, 2021. On January 6, 2023, the Department of Commerce announced the preliminary results of the administrative reconsideration in the Federal Register, but the final investigation results have not yet been published, and the tentative deadline is May 8, 2023.
However, as the May 8 deadline approached, the Commerce Department announced a delay in publishing the final results.
The U.S. Department of Commerce stated that due to the additional time needed to analyze the complex issues raised in the case and the rebuttals submitted by relevant parties, the final findings of the investigation cannot be released before May 8, 2023.
For this reason, the U.S. Department of Commerce applied for another 55-day extension, and set the date for the announcement of the final review results to June 30, 2023.
According to the U.S. tariff law, the Ministry of Commerce should announce the final findings of the anti-dumping investigation within 120 days after the preliminary results of the anti-dumping investigation are announced, but if the review cannot be completed within this period, it can be extended to 180 days.
